Welcome to Luxe Thai Massage

These Terms & Conditions (“Terms”) govern access to and use of Luxe Thai Massage, LLC’s website, online booking system, communications, premises, massage services, promotions, gift cards, and related offerings.

In these Terms, “Luxe Thai Massage,” “LTM,” “we,” “us,” and “our” refer to Luxe Thai Massage, LLC. “Client,” “you,” and “your” refer to the person booking, purchasing, receiving, or otherwise using our services.

By booking an appointment, purchasing a service or gift card, participating in a promotion, entering our premises, or using our website, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

Relationship to the Luxe VIP Membership Terms

The Luxe VIP Membership Terms & Conditions supplement these Terms and govern membership-specific matters, including:

  • Recurring membership billing;

  • Monthly included membership sessions;

  • Member pricing and upgrades;

  • Loyalty rewards;

  • Membership pauses;

  • Membership cancellation;

  • Membership-session rollover and expiration; and

  • Other membership-specific benefits.

If these Terms conflict with the Luxe VIP Membership Terms regarding a membership-specific matter, the Luxe VIP Membership Terms will control.

These standard Terms will control all other matters, including general booking requirements, professional conduct, health disclosures, premises rules, sanitation, draping, gift cards, referral rewards, and non-membership services.

Acceptance of Terms

By booking an appointment, purchasing a service, or using our website, you confirm that you are legally capable of accepting these Terms.

A parent or legal guardian who books a service for a minor accepts these Terms on behalf of both the guardian and the minor.

Where an online booking or purchase presents an acknowledgment checkbox, selecting that checkbox constitutes affirmative acceptance of the linked policies.

If you do not agree to these Terms, do not book, purchase, or use our services.

Minors, Accompanying Children, and Guardian Consent

Clients Under Age 18

Clients under age 18 must have written consent from a parent or legal guardian before massage services are performed.

Luxe Thai Massage may require:

  • A completed minor consent form;

  • Identification from the parent or guardian;

  • The parent or guardian to remain on the premises;

  • The parent or guardian to be present during the consultation; or

  • Other reasonable safeguards based on the minor’s age and the requested service.

Luxe Thai Massage may refuse or postpone service if the required consent or documentation has not been provided.

Accompanying Children

Children under age 12 who are not receiving a scheduled service must remain under the direct supervision of a parent, legal guardian, or other responsible adult age 18 or older at all times while on the premises.

This supervision requirement applies in:

  • Reception areas;

  • Hallways;

  • Treatment rooms;

  • Restrooms;

  • Exterior areas; and

  • All other areas of the premises.

Luxe Thai Massage employees, therapists, and independent contractors cannot supervise, watch, escort, or assume responsibility for an accompanying child.

The supervising adult should ordinarily be someone who is not receiving a massage or other service.

A client who arrives without appropriate supervision for an accompanying child may be denied service or have the appointment canceled. The applicable cancellation policy will apply, and the client will not be entitled to a refund, account credit, complimentary rescheduling, appointment extension, or other compensation.

Limited Supervision Exception

In limited circumstances, management may permit a parent or guardian receiving a service to remain responsible for an accompanying child.

Any such exception is granted solely at management’s discretion and does not create a right to the same exception during a future appointment.

If the child requires attention or assistance, including an escort to or from the restroom, the parent or guardian must pause the massage and personally assist the child.

The appointment will end at its originally scheduled time. Time missed while attending to the child will not be extended, restored, refunded, or credited.

Services Offered

Luxe Thai Massage provides professional massage services through appropriately licensed massage therapists.

Services may include:

  • Luxe Signature Massage;

  • Traditional Thai Massage;

  • Deep Tissue Massage;

  • Swedish Massage;

  • Couples Massage;

  • Four Hands Massage;

  • Foot Massage; and

  • Other services or enhancements listed on our website or booking system.

All services, techniques, enhancements, therapists, appointment durations, and treatment rooms are subject to eligibility and availability.

Massage services are provided for relaxation and general wellness purposes. They do not constitute medical diagnosis, medical treatment, physical therapy, chiropractic care, or another licensed healthcare service unless expressly stated and legally authorized.

Appointments and Walk-Ins

Appointments may be booked online or by telephone.

Walk-ins may be accommodated when an appropriate therapist, treatment room, and sufficient appointment time are available. Walk-in availability is not guaranteed.

A valid payment card may be required to reserve an appointment.

Appointments booked by telephone, text message, in person, or another staff-assisted method are subject to the same payment, cancellation, late-arrival, no-show, conduct, and service policies as online appointments.

Payment Authorization

By providing a payment card or other payment method, the client authorizes Luxe Thai Massage and its payment processor to charge:

  • The booked service price;

  • Applicable taxes;

  • Voluntary gratuities selected by the client;

  • Approved enhancements or upgrades;

  • Cancellation or no-show charges;

  • Reasonable cleaning or damage charges;

  • Valid unpaid balances; and

  • Other amounts expressly authorized under these Terms.

Charges will be limited to amounts reasonably due under the applicable booking, purchase, or policy.

Clients are responsible for maintaining accurate payment and contact information.

Online Discounts, Coupons, and Promotions

Any online booking discount, coupon, promotional code, gift certificate, referral credit, or other offer must be selected, entered, and successfully applied before checkout is completed.

Unless expressly stated otherwise:

  • Discounts cannot be added after payment;

  • Offers cannot be applied retroactively;

  • Promotions cannot be redeemed for cash;

  • Promotions cannot be transferred;

  • Promotions cannot be combined or stacked;

  • Promotions cannot be applied toward gift cards or membership fees; and

  • Expired offers will not be reinstated.

If a client completes payment without properly applying an eligible offer, the paid booking will be honored as submitted. Luxe Thai Massage is not required to reverse the transaction, issue a refund, or retroactively apply the offer.

Additional restrictions displayed with a particular promotion are incorporated into these Terms.

Couples and Four Hands Massage Bookings

Couples Massage and Four Hands Massage require coordination of multiple therapists, appropriate appointment times, and a suitable treatment suite.

These services may be required to be booked online, particularly during:

  • Weekends;

  • Holidays;

  • Peak-demand periods;

  • Special events; or

  • Other high-volume times.

A request for a particular therapist combination, therapist gender, room, date, or time is not guaranteed.

Check-In and Appointment Timing

Clients should arrive at least 15 minutes before the scheduled appointment time to allow for:

  • Check-in;

  • Intake documentation;

  • Consultation;

  • Health disclosures;

  • Changing or preparation; and

  • Transition into the treatment room.

The scheduled appointment period may include reasonable time for consultation, preparation, dressing, undressing, and transition.

Late arrival does not extend the scheduled ending time.

Service Modifications and Therapist Assignments

Luxe Thai Massage may modify, substitute, limit, or discontinue a service, enhancement, technique, therapist assignment, or room assignment when reasonably necessary because of:

  • Therapist availability;

  • Scheduling needs;

  • Operational requirements;

  • Equipment limitations;

  • Health contraindications;

  • Client safety;

  • Therapist safety;

  • Professional judgment; or

  • Other legitimate business reasons.

Luxe Thai Massage will make reasonable efforts to provide the booked service or an appropriate alternative.

If Luxe Thai Massage is unable to provide the scheduled service and no reasonable substitute is accepted, the client may reschedule or receive a refund of the amount paid for the unprovided service.

Therapist Requests

Luxe Thai Massage will make reasonable efforts to accommodate therapist requests but does not guarantee:

  • A particular therapist;

  • Therapist gender;

  • A specific therapist combination;

  • A specific treatment room; or

  • The continued availability of a requested therapist.

A therapist substitution alone does not entitle the client to a refund, discount, or cancellation without penalty unless Luxe Thai Massage cannot provide the scheduled service.

Booking, Cancellation, Rescheduling, and Refund Policy

By booking an appointment, the client acknowledges and agrees to the following cancellation and refund policy.

Rescheduling Requests

Requests to reschedule are subject to availability and are not guaranteed.

If Luxe Thai Massage cannot accommodate a requested reschedule, the original appointment and applicable cancellation policy remain in effect.

Changing an appointment’s date, time, therapist, duration, or service may be treated as a cancellation and rebooking when the requested change cannot be accommodated within the existing reservation.

Cancellations Received at Least 24 Hours in Advance

A cancellation received at least 24 hours before the scheduled appointment time may be canceled or rescheduled without a cancellation penalty.

For a directly paid appointment, the amount paid will be refunded minus any applicable, disclosed, and non-recoverable payment-processing fees.

A valid promotional benefit or credit used for the appointment may be returned only if it remains unexpired and otherwise eligible under the terms governing that benefit.

Returning a benefit does not extend or restart its original expiration period.

Membership sessions and membership benefits are governed by the Luxe VIP Membership Terms & Conditions.

Cancellations Received at Least 5 Hours but Fewer Than 24 Hours in Advance

A directly paid appointment canceled at least 5 hours but fewer than 24 hours before the scheduled appointment time will incur a charge equal to 50% of the scheduled service price.

Any separately paid enhancement, upgrade, or other applicable service charge may be subject to the same 50% cancellation charge.

Promotional, complimentary, loyalty, referral, courtesy, and membership benefits may be subject to full forfeiture under the terms governing the applicable benefit.

Cancellations Received Fewer Than 5 Hours in Advance

A directly paid appointment canceled fewer than 5 hours before the scheduled appointment time will be charged 100% of the scheduled service price.

The appointment will not be eligible for:

  • A refund;

  • Account credit;

  • Complimentary rescheduling; or

  • Replacement service.

Any promotional, complimentary, loyalty, referral, courtesy, or membership benefit used for the appointment may be forfeited in full.

No-Shows

A client who does not arrive for the appointment will be treated as a no-show.

No-shows will be charged 100% of the scheduled service price and are not eligible for a refund, account credit, replacement benefit, or complimentary rescheduling.

A promotional, complimentary, loyalty, referral, courtesy, or membership benefit used for a no-show appointment may be permanently forfeited.

Fifteen-Minute Late-Arrival Cutoff

A client who has not arrived within 15 minutes after the scheduled appointment time may be marked as a no-show at management’s discretion.

Once an appointment is marked as a no-show:

  • The applicable full charge or benefit forfeiture will apply;

  • Luxe Thai Massage may release the appointment time;

  • The client is not guaranteed service if they subsequently arrive; and

  • Any later accommodation is solely at management’s discretion.

Late Arrivals Accepted for Service

If a late-arriving client is accepted for service, the session may be shortened to avoid delaying another appointment.

The session will end at its originally scheduled time.

The client remains responsible for the full scheduled service price. Missed service time will not be:

  • Extended;

  • Restored;

  • Refunded;

  • Prorated; or

  • Credited.

Cancellation and No-Show Exceptions

Luxe Thai Massage may, at its sole discretion:

  • Waive a cancellation charge;

  • Reduce a cancellation charge;

  • Return a forfeited benefit;

  • Permit limited-use rescheduling; or

  • Issue a courtesy credit.

Any exception is a one-time courtesy. It does not:

  • Modify these Terms;

  • Create precedent;

  • Establish a continuing business practice; or

  • Entitle the client to the same exception in the future.

A courtesy rescheduling credit may be subject to:

  • A specific expiration date;

  • Blackout dates;

  • Service restrictions;

  • Therapist restrictions;

  • Online-only booking;

  • Weekday-only booking; and

  • Appointment availability.

Membership Appointments

Membership billing, monthly sessions, loyalty rewards, benefit expiration, membership pauses, and membership cancellations are governed separately by the Luxe VIP Membership Terms & Conditions.

Membership-specific terms control if they conflict with these standard Terms.

Canceling or rescheduling an appointment does not cancel a membership or stop recurring membership billing.

Canceling a membership does not automatically cancel an appointment already scheduled.

Referral Program Terms

Luxe Thai Massage’s Referral Program allows qualifying clients to earn promotional referral credits for eligible personal referrals.

By participating, the referring client agrees to the following terms.

Qualifying Referral

A referral credit is awarded only when:

  • The referred person is a brand-new Luxe Thai Massage client;

  • The referral is properly documented before completion of the new client’s first qualifying service;

  • The new client completes an eligible individual massage of at least 60 minutes; and

  • All other Referral Program requirements are satisfied.

Qualifying Service

A qualifying service is an individual massage appointment lasting at least 60 minutes and completed by a brand-new client.

The following do not qualify:

  • Services shorter than 60 minutes;

  • A 30-minute Foot Massage;

  • Complimentary appointments;

  • Loyalty rewards;

  • Gifted promotional sessions;

  • Other non-paid appointments;

  • Couples Massage appointments;

  • Shared bookings;

  • Group appointments;

  • Multi-guest appointments; or

  • Appointments involving a returning client and a first-time client as part of the same shared service experience.

An appointment paid with a valid purchased gift card may qualify if all other requirements are satisfied.

Couples and Shared Booking Exclusion

A referral credit will not be issued when:

  • A returning client and first-time client attend together as part of a Couples Massage or shared booking;

  • A returning client books or pays for a shared appointment involving a new client;

  • The first-time client attends as part of a group or multi-guest service; or

  • The referral otherwise arises from a shared service experience.

Referral Documentation

The referral must be documented before the referred client completes the first qualifying service.

Acceptable documentation may include:

  • A Luxe Thai Massage referral card;

  • A referral code;

  • A booking note;

  • An intake-form entry; or

  • A staff-entered checkout note.

Undocumented, verbal, or retroactive referral claims are not eligible.

Referral Credit Issuance and Use

Referral credits:

  • Are issued as promotional coupon codes;

  • Are valid exclusively for eligible online bookings;

  • May be used only for individual massage services lasting at least 60 minutes;

  • Cannot be applied toward membership fees;

  • Cannot be applied toward gift cards;

  • Cannot be redeemed for cash;

  • Have no cash or exchange value;

  • Are non-transferable;

  • Cannot be sold, assigned, shared, or gifted;

  • Expire 60 calendar days after issuance; and

  • Cannot be reinstated after expiration.

The referring client is responsible for entering and successfully applying the referral coupon during online checkout.

Referral Eligibility Restrictions

Referral credits are intended for individual, personal referrals.

Referrals generated through a business relationship, commercial arrangement, partnership, affiliation, influencer relationship, promotional agreement, or similar arrangement are not eligible unless Luxe Thai Massage expressly agrees otherwise in writing.

The following are not eligible to earn referral credits:

  • Employees;

  • Independent contractors;

  • Affiliates;

  • Influencers;

  • Promotional partners; or

  • Anyone acting in a business or promotional capacity for Luxe Thai Massage.

Self-referrals, duplicate accounts, fictitious referrals, and attempts to manipulate or circumvent the referral system are prohibited.

Referral Credit Stacking

Referral credits may not be combined or stacked with another discount, promotion, coupon, or offer.

Multiple valid referral credits earned by the same client may be combined internally by Luxe Thai Massage into one coupon of equal total value.

Internal combination of referral credits:

  • Is performed solely by Luxe Thai Massage;

  • Is not available automatically at checkout;

  • Is not available upon demand;

  • Does not extend the original expiration date; and

  • Remains subject to all Referral Program restrictions.

Referral credits cannot be split across multiple transactions.

Referral Program Administration

Luxe Thai Massage may verify all referral claims and determine eligibility based on its records and these published requirements.

A referral credit may be withheld, canceled, or revoked if:

  • Eligibility requirements were not satisfied;

  • The credit was issued because of an error;

  • The referral was duplicated;

  • Fraud or manipulation occurred;

  • The coupon was transferred or misused; or

  • Activity was inconsistent with the intended personal-referral purpose.

Luxe Thai Massage may prospectively modify or discontinue the Referral Program.

A valid referral credit issued before a program change will remain redeemable through its stated expiration date unless it was obtained or used through fraud, duplication, ineligibility, or misuse.

Referral Communications

Participants may receive transactional referral communications by email or SMS.

Marketing messages will be sent only when the recipient has provided the required marketing consent.

Marketing consent is not required to participate in the Referral Program.

Gift Cards

Gift cards are subject to the following terms:

  • Purchased gift-card funds expire five years after the purchase date;

  • A gift card issued without a purchase expires five years after its issuance date;

  • The expiration date or expiration policy will be clearly disclosed at purchase or issuance;

  • Gift cards are non-refundable;

  • Gift cards cannot be exchanged for cash except where required by law;

  • Gift cards must be presented or applied at the time of booking or payment;

  • Gift cards cannot be applied toward VIP Membership fees;

  • Gift cards cannot be applied toward member-rate services;

  • Gift cards cannot be applied toward membership upgrades;

  • Gift cards are redeemable for eligible services or products at current prices;

  • Gift cards do not guarantee a particular price, discount, promotion, therapist, date, or appointment time; and

  • Gift-card purchases do not guarantee service availability.

Lost, Stolen, or Misplaced Gift Cards

  • Gift cards and gift card numbers are treated as cash.

  • The purchaser and holder are solely responsible for safeguarding the gift card and its gift card number.

  • If a gift card or gift card number is lost, stolen, misplaced, forgotten, transferred, disclosed to another person, or used without authorization, Luxe Thai Massage has no obligation to replace the gift card, restore any remaining balance, issue a refund, provide account credit, or otherwise compensate the holder for any resulting loss.

  • Once lost or used, the remaining value is the sole responsibility of the purchaser or holder and is not recoverable, except where otherwise required by applicable law.

  • Luxe Thai Massage is not responsible for any loss resulting from a customer's failure to safeguard a gift card or gift card number, or from any unauthorized redemption or use.

If Luxe Thai Massage is legally required to provide a different expiration, refund, or redemption treatment, applicable law will control.

Gratuities and Prepaid Tips

Gratuities are voluntary and are intended for the therapist who performs the service.

Luxe Thai Massage does not require a gratuity.

A prepaid gratuity associated with a completed service is non-refundable.

If the scheduled service is not performed, the prepaid gratuity will not be treated as payment for the unprovided massage service. Luxe Thai Massage may:

  • Refund the prepaid gratuity minus an applicable non-recoverable processing fee; or

  • With the client’s authorization, carry the gratuity forward for a future appointment.

If a different therapist provides the service, a prepaid gratuity may be reassigned to the therapist who actually performs the service.

A prepaid gratuity does not guarantee assignment to a particular therapist.

Payment, Refunds, and Service Concerns

Payment is due at the time specified during booking or checkout.

Luxe Thai Massage accepts the payment methods displayed through its website, booking system, or premises.

Completed Services

Completed massage services are non-refundable.

A client who has a concern regarding a service should notify management promptly so the matter can be reviewed.

Luxe Thai Massage may, at its discretion, offer an appropriate service recovery. A complaint does not automatically entitle the client to:

  • A refund;

  • A replacement massage;

  • Complimentary time;

  • An account credit; or

  • Another form of compensation.

Shortened or Modified Sessions

A partial refund will not be issued solely because:

  • The client arrived late;

  • The client chose to end the session early;

  • The client requested less pressure or a different technique;

  • A particular technique or enhancement was contraindicated;

  • The therapist modified the massage for health or safety reasons while providing the reserved session time;

  • The client needed to pause the session;

  • The client declined part of the booked service; or

  • The service was ended because of the client’s misconduct or violation of these Terms.

This provision does not authorize billing for services Luxe Thai Massage entirely failed to provide for reasons attributable solely to Luxe Thai Massage.

Pricing and System Errors

Luxe Thai Massage may correct:

  • Pricing errors;

  • Typographical errors;

  • Promotional errors;

  • Coupon errors;

  • Booking-system inaccuracies;

  • Duplicate discounts; and

  • Other unintended system results.

An incorrect displayed price, promotion, or system result does not require Luxe Thai Massage to honor an unintended rate or benefit.

If a corrected price is higher than the amount already paid, the client may accept the corrected price or cancel the affected booking for a refund before service is performed.

Hygiene, Transferable Products, and Linens

Clients must arrive reasonably clean and prepared for massage.

Strong or Persistent Odors

Clients must arrive without a strong or persistent odor of cigarette smoke, tobacco smoke, cannabis, alcohol, chemicals, fragrances, or another substance that may materially affect the treatment environment, remain on linens or furnishings, cause discomfort or sensitivity to a therapist or guest, or interfere with Luxe Thai Massage’s ability to provide services in a clean and professional setting.

Luxe Thai Massage may delay, modify, reschedule, refuse, or terminate service when management or the assigned therapist reasonably determines that an odor is sufficiently strong or persistent to materially affect sanitation, safety, staff, other guests, the treatment room, linens, furnishings, or subsequent appointments.

Any determination will be based on the client’s observable condition at the time of service and will be applied without unlawful discrimination.

If service is refused because the client arrived with a prohibited strong or persistent odor, the appointment may be treated as a same-day cancellation. The applicable cancellation charge or benefit forfeiture may apply, subject to management discretion and applicable law.

Removal of the source of the odor does not guarantee that service can be provided if the odor remains sufficiently strong or persistent.

Spray Tans, Makeup, Oils, and Transferable Products

Clients should not arrive with products likely to stain, damage, or contaminate linens or equipment, including:

  • Fresh spray tans;

  • Self-tanning lotions;

  • Heavy transferable makeup;

  • Body glitter;

  • Unapproved body oils;

  • Dyes;

  • Wet topical products; or

  • Other residue-producing substances.

Luxe Thai Massage may require the product to be removed, modify the service, or refuse service when the product creates a sanitation, safety, or property-damage concern.

If service is refused because the client arrived with a prohibited or undisclosed transferable product, the applicable same-day cancellation policy may apply.

Linen or Property Damage

A client may be charged a reasonable cleaning, repair, or replacement fee of up to $50 when linens, equipment, furnishings, or other property are damaged or materially stained because of:

  • Transferable products;

  • Undisclosed dyes or tanning products;

  • Negligent conduct;

  • Misuse;

  • Bodily-fluid contamination beyond ordinary massage use; or

  • Another preventable staining or damaging substance.

A higher documented charge may apply only if the client intentionally or recklessly causes property damage exceeding $50 and recovery is permitted by law.

Ordinary wear and tear is not chargeable.

Health Disclosures and Client Responsibilities

Clients must disclose relevant health information before service, including:

  • Pregnancy;

  • High blood pressure;

  • Heart conditions;

  • Blood-clotting concerns;

  • Recent surgery;

  • Recent injury;

  • Fractures;

  • Allergies;

  • Skin conditions;

  • Contagious illness;

  • Fever;

  • Open wounds;

  • Medication use;

  • Reduced sensation;

  • Neurological conditions; and

  • Any other condition that may affect massage safety.

Failure to disclose relevant information may limit Luxe Thai Massage’s ability to provide safe and appropriate service.

Clients should consult a qualified healthcare professional before receiving massage if they are uncertain whether massage is appropriate.

Clients must reschedule when they are ill, contagious, or otherwise unable to safely receive massage.

The standard cancellation policy applies unless an exception is granted.

Physician Clearance

Luxe Thai Massage may require written clearance from an appropriate healthcare professional when a condition, injury, surgery, pregnancy complication, medication, or treatment may affect massage safety.

Luxe Thai Massage may postpone or refuse service until appropriate clearance is received.

Oils, Allergies, and Enhancements

Clients are responsible for disclosing allergies, sensitivities, skin reactions, respiratory concerns, and other relevant contraindications before use of:

  • Massage oils;

  • Essential oils;

  • Aromatherapy;

  • Balms;

  • Heat;

  • Hot stones;

  • Topical products; or

  • Other enhancements.

Professional Draping and Boundaries

Professional draping is required during all massage services.

The genital area and gluteal cleavage will remain draped at all times.

For female clients, the breasts will remain draped except where a specific service is legally permitted, professionally appropriate, and supported by any required written consent.

Only the area actively being treated may be temporarily uncovered by the therapist in a professionally appropriate manner.

Clients may not request:

  • Removal of required draping;

  • Exposure of intimate areas;

  • Massage of prohibited areas;

  • Sexual touching;

  • Sexualized service; or

  • Conduct inconsistent with professional massage therapy.

A request or action violating professional draping or boundaries may result in immediate termination of the session, full charge, permanent denial of service, and referral to law enforcement when appropriate.

Sexual Conduct and Inappropriate Behavior

Luxe Thai Massage has a zero-tolerance policy for sexual conduct.

The therapist must end the session if a client initiates verbal or physical conduct that is sexual in nature or intended to arouse or gratify sexual desire.

Prohibited conduct includes:

  • Sexual comments;

  • Sexual jokes or innuendo;

  • Requests for sexual services;

  • Deliberate exposure;

  • Sexual touching;

  • Attempts to touch a therapist;

  • Requests to remove professional draping;

  • Masturbation;

  • Intentional sexual discharge; and

  • Gestures or behavior reasonably interpreted as sexual.

If a session is terminated for prohibited conduct:

  • The full scheduled price remains due;

  • No refund or credit will be provided;

  • The client may be permanently denied future service;

  • Membership or promotional benefits may be forfeited under their applicable terms; and

  • The conduct may be reported to law enforcement or an appropriate authority.

Accidental Bodily-Fluid Exposure

An accidental bodily-fluid exposure that creates a material sanitation, health, or safety concern may require the massage to pause or end.

Management will determine the appropriate charge, cleaning procedure, and service response based on:

  • The nature of the incident;

  • Whether the incident was accidental;

  • Whether relevant health information was disclosed;

  • The time and service already provided;

  • Sanitation requirements; and

  • Applicable law.

Intentional sexual discharge is governed by the Sexual Conduct and Inappropriate Behavior section.

Code of Conduct and Right to Refuse Service

Luxe Thai Massage may refuse, interrupt, or terminate service for any lawful reason reasonably related to safety, health, professional boundaries, operations, or policy compliance.

Prohibited conduct includes:

  • Unwanted touching;

  • Harassment;

  • Threats;

  • Abusive or degrading language;

  • Discriminatory harassment;

  • Sexual conduct;

  • Inappropriate requests;

  • Intimidation;

  • Violence;

  • Fraud;

  • Theft;

  • Deliberate property damage;

  • Repeated policy violations;

  • Interference with another client’s experience;

  • Unsafe behavior;

  • Material hygiene concerns; and

  • Conduct that compromises the safety or comfort of staff or guests.

Credible reports of prior threats, harassment, violence, sexual misconduct, fraud, or similar safety-related conduct may be considered when deciding whether to accept a booking.

Luxe Thai Massage may permanently deny service when reasonably necessary to protect clients, therapists, staff, or the business.

Intoxication and Impairment

Clients who appear intoxicated, impaired, under the influence of drugs, or otherwise unable to safely receive massage may be refused service or have the session terminated.

Relevant indicators may include:

  • Impaired coordination;

  • Slurred speech;

  • Aggressive behavior;

  • Inability to provide informed consent;

  • Inability to follow safety instructions;

  • Loss of consciousness;

  • Strong odor of alcohol; or

  • Other observable safety concerns.

If service is refused or terminated because of the client’s intoxication or impairment, the appointment will be treated as reserved and rendered for billing purposes. The full scheduled price or applicable benefit forfeiture may apply, and no refund or complimentary rescheduling will be provided.

Adverse Weather, Emergencies, and Force Majeure

Luxe Thai Massage may cancel, delay, reschedule, or modify appointments because of:

  • Severe weather;

  • Natural disasters;

  • Unsafe road conditions;

  • Government advisories;

  • Power outages;

  • Water outages;

  • Utility failures;

  • Building emergencies;

  • Equipment failures;

  • Staffing emergencies;

  • Public-health events; or

  • Other circumstances beyond Luxe Thai Massage’s reasonable control.

If Luxe Thai Massage cancels an appointment because of such circumstances:

  • The client will not be charged a cancellation penalty;

  • A session or promotional benefit will not be forfeited;

  • The client may reschedule subject to availability; and

  • A directly paid service may be refunded if rescheduling is not reasonably available or accepted.

If a client cannot attend because of severe or unsafe weather, Luxe Thai Massage may waive an otherwise applicable cancellation charge or forfeiture at its discretion.

Clients should provide notice as soon as reasonably possible.

Luxe Thai Massage’s determination concerning operational safety will be final, subject to applicable law.

Security Cameras and Premises Monitoring

Luxe Thai Massage may use video surveillance in common and exterior areas for:

  • Safety;

  • Security;

  • Loss prevention;

  • Incident review; and

  • Operational purposes.

Monitored areas may include:

  • Entrances;

  • Reception areas;

  • Hallways;

  • Parking or exterior areas; and

  • Other non-private common areas.

No video or audio recording occurs in:

  • Treatment rooms;

  • Restrooms; or

  • Other areas where privacy is reasonably expected.

By entering monitored common areas, clients acknowledge the disclosed use of video surveillance.

Personal Property

Clients are responsible for their personal belongings.

To the fullest extent permitted by law, Luxe Thai Massage is not responsible for lost, stolen, misplaced, or damaged personal property unless the loss was directly caused by conduct for which liability cannot legally be excluded.

Clients should avoid bringing valuables to appointments.

No Medical Guarantee

Luxe Thai Massage does not guarantee:

  • Pain relief;

  • Medical improvement;

  • Therapeutic results;

  • Relaxation outcomes;

  • Permanent results; or

  • Any other specific outcome.

Massage therapists do not diagnose illnesses, prescribe medication, or represent massage as a substitute for medical evaluation or treatment.

A recommendation to seek medical care is not a diagnosis.

Transactional and Marketing Communications

By booking a service or providing contact information, clients agree to receive transactional communications related to:

  • Appointment confirmations;

  • Appointment reminders;

  • Schedule changes;

  • Payment notices;

  • Policy notices;

  • Service updates;

  • Requested support; and

  • Other necessary business communications.

Transactional messages may be sent by email, telephone, or SMS.

Marketing and promotional messages will be sent only when the client has provided any legally required consent.

Marketing consent is optional and is not required to book or receive services.

Message frequency may vary. Message and data rates may apply.

Clients may opt out of marketing text messages by replying STOP.

Opting out of marketing messages does not prevent Luxe Thai Massage from sending necessary transactional communications.

Privacy and Client Information

Luxe Thai Massage may collect and maintain personal, booking, payment, health, and service information as reasonably necessary to:

  • Schedule services;

  • Process payments;

  • Provide massage safely;

  • Maintain required records;

  • Communicate with clients;

  • Resolve disputes;

  • Prevent fraud; and

  • Comply with law.

Client information will be handled in accordance with Luxe Thai Massage’s Privacy Policy and applicable legal requirements.

Clients are responsible for providing accurate information.

Chargebacks and Payment Disputes

Clients are encouraged to contact Luxe Thai Massage promptly so we may attempt to resolve a billing concern directly.

Nothing in these Terms limits a billing-error, chargeback, or payment-dispute right that cannot legally be waived.

Fraudulent, knowingly false, duplicative, or bad-faith payment disputes may result in:

  • Denial of future services;

  • Cancellation of pending appointments;

  • Suspension or termination of membership participation;

  • Collection of a valid unpaid balance; and

  • Recovery of documented dispute fees or losses where permitted by law.

Merely raising a legitimate billing concern or exercising a lawful dispute right will not automatically result in a penalty.

Website Use

Clients may not:

  • Use the website for an unlawful purpose;

  • Attempt unauthorized access;

  • Interfere with website functionality;

  • Introduce malicious code;

  • Scrape or copy protected content without permission;

  • Impersonate another person;

  • Submit false booking or payment information;

  • Create fraudulent accounts; or

  • Circumvent booking, payment, promotion, or security controls.

Luxe Thai Massage may restrict website or booking access when reasonably necessary to prevent abuse, fraud, interference, or security threats.

Intellectual Property

The website and its content—including text, logos, graphics, photographs, videos, service names, page designs, and original materials—are owned by or licensed to Luxe Thai Massage, LLC.

No content may be reproduced, republished, distributed, modified, sold, or commercially used without prior written authorization, except where permitted by law.

Third-Party Services and Links

The website and booking process may use or link to third-party services, including:

  • Booking providers;

  • Payment processors;

  • Mapping services;

  • Social-media platforms; and

  • External websites.

Luxe Thai Massage is not responsible for a third party’s:

  • Availability;

  • Content;

  • Privacy practices;

  • Security;

  • Errors;

  • Terms; or

  • Independent conduct.

Use of a third-party service may also be subject to that provider’s terms and policies.

Disclaimers

Services and website content are provided on an “as available” basis to the extent permitted by law.

Luxe Thai Massage does not warrant that:

  • Every service will be available at all times;

  • Every website feature will operate without interruption;

  • A particular therapist will remain available;

  • A massage will produce a particular result; or

  • General educational website content will apply to a client’s individual health circumstances.

Nothing in these Terms excludes a warranty or consumer protection that cannot legally be excluded.

Limitation of Liability

To the fullest extent permitted by law, Luxe Thai Massage, LLC and its owners, staff, therapists, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from:

  • Website use;

  • Loss of data;

  • Lost profits;

  • Missed opportunities;

  • Third-party services;

  • Unauthorized gift-card use;

  • Appointment unavailability; or

  • Another matter arising from these Terms.

This limitation does not exclude liability for gross negligence, willful misconduct, or another matter that cannot legally be limited.

Nothing in these Terms replaces the informed-consent, health-disclosure, or acknowledgment documents completed for massage services.

Indemnification

To the extent permitted by law, a client agrees to reimburse Luxe Thai Massage for reasonable losses, property damage, claims, or expenses directly caused by the client’s:

  • Fraud;

  • Intentional misconduct;

  • Unlawful conduct;

  • Material breach of these Terms;

  • Deliberate property damage;

  • Misuse of the website; or

  • Violation of another person’s rights.

This provision does not require a client to indemnify Luxe Thai Massage for Luxe Thai Massage’s own negligence or other conduct for which indemnification cannot legally be required.

Policy Enforcement and Termination of Access

Luxe Thai Massage may:

  • Decline a booking;

  • Cancel an appointment;

  • Restrict online access;

  • Refuse service;

  • End an ongoing session;

  • Revoke a promotional benefit obtained through misuse; or

  • Permanently deny future service

when reasonably necessary to enforce these Terms, comply with law, protect safety, prevent fraud, or maintain professional boundaries.

Any cancellation, charge, forfeiture, or refund will be determined under the applicable provision of these Terms.

Modifications to Terms

Luxe Thai Massage may prospectively update these Terms, policies, services, prices, or procedures.

The updated Terms will identify an effective date.

Material changes will be communicated through reasonable means when appropriate.

Changes will not retroactively:

  • Increase an amount already paid;

  • Shorten the expiration date of an already-issued purchased gift card;

  • Alter the cancellation terms applicable to an appointment booked before the change’s effective date; or

  • Revoke an already-issued valid promotional credit unless fraud, duplication, ineligibility, or misuse occurred.

Appointments and purchases made before a change’s effective date remain governed by the terms in effect when the transaction was completed, except where a change is required by law or necessary for immediate health, safety, fraud-prevention, or security reasons.

Continued booking or use of services after the effective date of revised Terms constitutes acceptance of the revised Terms, except where additional affirmative consent is legally required.

Compliance With Applicable Law

These Terms are intended to comply with applicable federal, Texas, and local law.

Nothing in these Terms:

  • Waives a non-waivable right;

  • Limits a remedy that cannot legally be limited;

  • Authorizes a prohibited charge;

  • Eliminates a mandatory disclosure; or

  • Overrides an applicable legal requirement.

If applicable law requires a result different from these Terms, applicable law will control.

No Waiver

A failure or delay by Luxe Thai Massage in enforcing a provision does not waive the right to enforce it later.

An exception, refund, waiver, courtesy credit, or accommodation does not:

  • Amend these Terms;

  • Create precedent;

  • Establish a continuing business practice; or

  • Require the same treatment in the future.

Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, it will be enforced to the maximum extent permitted or severed as necessary.

The remaining provisions will continue in full force and effect.

Governing Law and Venue

These Terms are governed by the laws of the State of Texas.

Any legal proceeding arising from these Terms, the website, a booking, or a service must be brought in a court of competent jurisdiction located in Bexar County, Texas, unless applicable law requires otherwise.

  • Understand the cancellation, late-arrival, and no-show policies;

  • Understand the professional conduct and draping requirements;

  • Agree to disclose relevant health information;

  • Accept the applicable payment, refund, gift-card, and promotional restrictions; and

  • Understand that membership-specific matters are governed separately by the Luxe VIP Membership Terms & Conditions.
