This Luxe VIP Membership Policy (“Policy”) supplements the general Terms and Conditions of Luxe Thai Massage, LLC (“Luxe Thai Massage,” “LTM,” “we,” “us,” or “our”) and governs participation in the Luxe VIP Membership program.

By enrolling in the Luxe VIP Membership, authorizing recurring payments, or using a membership session or benefit, the member acknowledges that they have read, understood, and agreed to this Policy and Luxe Thai Massage’s general Terms and Conditions.

Relationship to General Terms and Conditions

This Policy supplements Luxe Thai Massage’s general Terms and Conditions.

If this Policy conflicts with the general Terms and Conditions regarding membership billing, monthly membership sessions, loyalty rewards, membership cancellation, session expiration, or another membership-specific benefit, this Policy will control.

Luxe Thai Massage’s general Terms and Conditions will control all other matters, including professional conduct, health disclosures, premises rules, general service policies, and matters not specifically addressed in this Policy.

Membership Overview and Recurring Billing

The Luxe VIP Membership is a recurring monthly wellness membership billed at $89 per month.

A one-time, non-refundable $25 enrollment fee is charged when the membership begins.

The monthly membership payment will be charged automatically on the calendar date corresponding to the member’s original enrollment date. For example, a membership beginning on May 3 will ordinarily renew on June 3 and on the third day of each following month.

If a month does not contain the corresponding calendar date, the payment may be processed on the last calendar day of that month.

Membership payments will continue automatically until the membership is canceled in accordance with the Membership Cancellation Requests section of this Policy.

Each successfully paid membership cycle issues one (1) 60-minute Luxe Signature Massage to the member’s account.

Membership enrollment fees and monthly membership payments are non-refundable after processing, including in cases of non-use, partial use, voluntary cancellation, or early cancellation, except where otherwise required by law or when a charge resulted from a verified billing error by Luxe Thai Massage.

Members are responsible for maintaining an accurate payment method, email address, telephone number, and other account information.

Members must notify Luxe Thai Massage of any change to their email address, telephone number, or other membership contact information by email to info@luxethaimassage.com. Contact-information changes are effective after Luxe Thai Massage receives and processes the request. Members remain responsible for communications, rewards, notices, or other membership information sent to the contact information on file before the requested change has been processed.

A contact-information change request must include the member's full name, the email address currently associated with the membership account, and the requested change. Luxe Thai Massage may require reasonable identity verification before processing a contact-information change.

Membership benefits are available only to active, paid members in good standing.

Except for the seventh-visit loyalty reward as specifically permitted below, membership sessions, pricing, and benefits are personal to the enrolled member and may not be sold, shared, assigned, transferred, or gifted.

Monthly Included Membership Session

Each successfully completed monthly membership payment issues one (1) monthly included 60-minute Luxe Signature Massage.

A monthly included membership session:

Is issued only after the applicable monthly payment has been successfully processed;
May not be used or reserved before it has been issued;
May not be split into shorter appointments;
May not be combined or pooled with another monthly session;
May not be transferred or gifted to another person;
May not be converted into cash, account credit, merchandise, a gift card, or another service; and
Remains subject to all booking, cancellation, rollover, and expiration requirements stated in this Policy.

Monthly included membership sessions are issued as individual 60-minute sessions.

A monthly included membership session may be applied as the 60-minute base of an eligible 90-minute or 120-minute appointment only when the applicable upgrade fee is paid.

Membership Upgrades and Included Perks

Members may upgrade an eligible monthly included session at the following rates:

Add 30 minutes for a 90-minute appointment: $45
Add 60 minutes for a 120-minute appointment: $90

Upgrade availability is subject to therapist, room, and scheduling availability.

An upgrade fee does not issue an additional monthly session and does not cause the appointment to count as more than one visit toward the loyalty reward.

Showers are available to active VIP Members at a reduced rate of $10 for a 20-minute shower reservation, compared with the regular $15 rate, subject to room, staff, scheduling, and operational availability.

Membership pricing and perks may not be combined with another discount, promotion, gift card, coupon, or outside offer except where expressly permitted by this Policy. The seventh-visit Loyalty Reward is expressly permitted to be applied with applicable VIP Member pricing in accordance with the Loyalty Reward Use section of this Policy.

Birthday Bonus

An active VIP Member may receive one complimentary 30-minute birthday add-on, subject to the following requirements:

The bonus must be booked and used on the member’s actual birthday;
The member must request the birthday bonus when the appointment is booked;
The bonus is subject to appointment, therapist, and scheduling availability;
The bonus is an add-on and may not be redeemed as a separate standalone appointment;
The bonus has no cash, refund, credit, transfer, or exchange value; and
Failure to request the bonus before the booking is finalized may result in forfeiture because additional appointment time may not be available.

The birthday bonus is not automatically applied, does not count toward the loyalty reward, and is not guaranteed if the member does not provide advance notice.

An exception allowing use on another date may be granted only at the sole discretion of Luxe Thai Massage and does not create precedent or a right to future exceptions.

Loyalty Reward After Six Eligible Visits

Loyalty Reward Change Effective Date: The changes to the seventh-visit Loyalty Reward described in this Policy, including its redemption value, gifting terms, reward issuance requirements, and post-cancellation treatment, take effect on 2 September 2026 (“Loyalty Reward Change Effective Date”). Loyalty Rewards issued before the Loyalty Reward Change Effective Date remain governed by the redemption value, gifting rights, restrictions, and other material terms applicable to the reward when it was issued.

For purposes of the Loyalty Reward, an “Eligible 60-Minute Massage” means any 60-minute individual massage service offered by Luxe Thai Massage for a single client. Couples Massage, Four Hands Massage, Massage for 2, and any other multi-guest or multi-therapist service are excluded unless Luxe Thai Massage expressly states otherwise.

An active VIP Member will receive one (1) seventh-visit Loyalty Reward after completing six (6) eligible member visits, subject to the requirements of this Policy.

The Loyalty Reward has two separate methods of redemption:

Member Redemption: When redeemed by the member who earned the reward while that member is active, paid, and in good standing, the reward provides one (1) complimentary Eligible 60-Minute Massage.
Gifted Redemption: When the reward is gifted or otherwise redeemed by a person other than the member who earned it, the reward provides a fixed $90 promotional discount toward one Eligible 60-Minute Massage. A Gifted Redemption has a fixed promotional value of $90 and does not guarantee that the recipient's massage will be provided at no charge. If the recipient's otherwise applicable eligible service price is $90 or less, application of the reward may result in no balance being due for the eligible base massage. The reward does not provide any residual, cash, or carry-forward value.

Maturation Period

The member must remain continuously active, paid, and in good standing for three (3) full billing cycles before visits begin accumulating toward the loyalty reward. This period is referred to as the “Maturation Period.”

Visits completed before the Maturation Period has been satisfied do not count retroactively.

Eligible-visit accumulation begins after the member has completed the three full billing cycles.

Eligible Visits

The following completed appointments count toward the loyalty reward:

A completed massage redeemed through the member’s monthly included membership session; and
An additional completed massage purchased at an applicable member rate.

A monthly included session counts because it is funded by the member’s recurring membership payment.

Each eligible completed appointment counts as one (1) visit, regardless of:

Appointment duration;
Service price;
Service format;
Number of guests; or
Number of therapists involved.

A 90-minute appointment counts as one visit.

A 120-minute appointment counts as one visit.

A Four Hands Massage appointment counts as one visit.

A Couples Massage appointment counts as one (1) eligible visit total and does not count as two visits merely because two guests receive services. The visit will be credited only to the active member account used to book or redeem the appointment. If two active members separately redeem their own monthly membership sessions for the same Couples Massage appointment, each member will receive one (1) eligible visit.

The following do not count toward a loyalty reward:

Canceled appointments;
Missed appointments;
No-shows;
Forfeited appointments;
Birthday bonuses;
Referral rewards;
Courtesy credits;
Promotional services;
Previously redeemed seventh-visit loyalty rewards;
Other complimentary services; and
Any appointment that was not completed.

After six eligible visits have been completed, Luxe Thai Massage will issue the loyalty reward and the eligible-visit counter will reset to zero.

The member may begin accumulating visits toward the next reward after the previous reward has been issued. The previous reward does not have to be redeemed before the next six-visit accumulation period begins.

Luxe Thai Massage reserves the right to review and verify all visit records before issuing a reward.

Any attempt to falsify, duplicate, manipulate, transfer, or circumvent visit counts may result in forfeiture of the reward and suspension or termination of membership benefits.

Loyalty Reward Use

The Loyalty Reward is a single-use promotional loyalty benefit issued after the member satisfies the eligibility requirements stated in this Policy. The reward does not create a cash balance, account balance, gift-card balance, or right to receive cash.

The reward may be redeemed either by the member who earned it or may be gifted to another person, subject to the following requirements.

Previously Issued Loyalty Rewards

The Loyalty Reward provisions described in this version of the Policy apply to Loyalty Rewards issued on or after the Loyalty Reward Change Effective Date.

A Loyalty Reward issued before that effective date remains governed by the redemption value, gifting rights, restrictions, and other material terms applicable to that reward when it was issued.

Luxe Thai Massage will not retroactively reduce the stated redemption value or materially reduce the gifting rights of a previously issued and unexpired Loyalty Reward solely because the Loyalty Reward program has subsequently been modified.

Previously issued rewards remain subject to their original expiration dates and all other applicable terms in effect when issued.

Member Redemption

When the member who earned the reward is an active VIP Member, paid and in good standing at the time of redemption, the Loyalty Reward entitles that member to one (1) complimentary Eligible 60-Minute Massage.

For a qualifying Member Redemption, the Loyalty Reward covers the full applicable VIP Member price of the base Eligible 60-Minute Massage.

Member Redemption is a complimentary-service benefit rather than a promise of a fixed $90 discount. If the applicable VIP Member price of the eligible 60-minute massage changes while an issued Loyalty Reward remains valid, Luxe Thai Massage will apply any adjustment reasonably necessary so that the eligible base 60-minute massage remains complimentary to the member who earned the reward, provided all Member Redemption requirements are satisfied.

Only the base 60-minute massage is complimentary.

The Loyalty Reward does not include or discount:

Additional massage time;
Service extensions;
Upgrades;
Enhancements;
Add-ons;
Showers;
Gratuities;
Applicable taxes or legally required charges, if any; or
Any other separately priced product or service.

Any such additional amount must be paid in full at the applicable rate.

A member may book an otherwise eligible extension, upgrade, enhancement, or add-on in connection with the complimentary massage, but the Loyalty Reward applies only to the eligible base 60-minute massage. The member remains responsible for the full applicable price of all additional services, time, enhancements, extensions, and add-ons.

Gifted Redemption

The member who earned an unused and unexpired Loyalty Reward may gift the reward to another person.

When the Loyalty Reward is redeemed by any person other than the member who earned it, the reward automatically becomes a fixed $90 promotional discount.

A Gifted Redemption has a fixed promotional value of $90 and does not guarantee that the recipient's massage will be provided at no charge. If the recipient's otherwise applicable eligible service price is $90 or less, application of the reward may result in no balance being due for the eligible base massage. The reward does not provide any residual, cash, or carry-forward value.

The recipient is responsible for paying:

Any portion of the eligible massage price exceeding $90; and
The full applicable price of any additional time, extension, upgrade, enhancement, add-on, product, gratuity, or other separately priced charge.

For example, if the applicable price of the recipient's eligible 60-minute massage is $115, application of the $90 Gifted Redemption leaves a $25 service balance payable by the recipient before any additional services or charges are added.

A gifted Loyalty Reward does not transfer the VIP Membership and does not, by itself, provide the recipient with VIP Member pricing, membership sessions, membership perks, or any other membership benefit.

If the recipient independently maintains an active VIP Membership, any member pricing otherwise available through that recipient's own membership may apply in accordance with this Policy.

Reward Application and Additional Charges

For purposes of determining the amount owed, the Loyalty Reward is applied to the eligible base massage before determining the amount due for separately priced extensions, upgrades, enhancements, add-ons, or other additional services.

A website, booking platform, checkout page, coupon system, or other software display does not expand the scope or value of the Loyalty Reward beyond the benefit expressly stated in this Policy.

If an obvious booking, coupon, pricing, or software configuration error incorrectly applies the Loyalty Reward to an ineligible service or charge, Luxe Thai Massage may correct the error before the service is provided and will disclose any resulting balance due.

General Loyalty Reward Restrictions

The Loyalty Reward:

Must be redeemed within 90 calendar days after issuance;
May be redeemed only once;
Is exhausted upon its first valid redemption;
May not be divided into multiple redemptions;
May not be exchanged for cash, account credit, a gift card, merchandise, or another benefit;
Has no residual, remaining, or carry-forward value after redemption;
May not be combined with another promotion, discount, reward, or coupon except where expressly permitted by this Policy;
Does not count as an eligible visit toward another Loyalty Reward; and
Remains subject to all applicable booking, cancellation, expiration, eligibility, and service requirements.

Reward Issuance, Email Delivery, and Redemption Responsibility

Upon completion and verification of the sixth eligible completed member visit, Luxe Thai Massage will issue the seventh-visit Loyalty Reward by emailing a single-use coupon code to the email address associated with the member's membership account.

The reward email will clearly identify that:

The member who earned the reward may redeem it for one complimentary Eligible 60-Minute Massage while eligible for Member Redemption;
If the reward is gifted or redeemed by another person, the recipient receives a fixed $90 promotional discount;
Additional time, extensions, upgrades, enhancements, add-ons, and other separately priced charges are not included in the reward; and
The reward is subject to its stated expiration date and the redemption requirements of this Policy.

The reward is considered issued on the date the reward email is sent to the membership email address on file.

The reward email will identify the benefit as a promotional loyalty reward and will provide:

The applicable coupon code;
The reward description;
The issuance date;
The exact expiration date; and
Any applicable redemption restrictions.

Members are responsible for:

Maintaining an accurate email address;
Reviewing the email address associated with their membership;
Checking inbox, spam, junk, promotional, and filtered email folders;
Retaining the coupon code; and
Redeeming the reward before its stated expiration date.

Failure to open, read, receive, locate, retain, or use the reward email or coupon code does not extend the expiration date and does not entitle the member or recipient to a replacement reward, refund, account credit, or expiration extension.

Luxe Thai Massage is not required to provide additional expiration reminders, follow-up notices, or requests asking whether the member wishes to use the reward.

Online Loyalty Reward Bookings

For an online booking, the coupon code must be entered and successfully applied during checkout.

The reward will not be automatically applied to an online appointment.

If a member or recipient completes an online payment without entering and applying the coupon code, the paid appointment will be honored as booked. Luxe Thai Massage is not required to:

Refund the payment;
Reverse the transaction;
Apply the coupon retroactively;
Extend the coupon expiration date; or
Issue a replacement reward.

Staff-Assisted Loyalty Reward Bookings

For a booking made by telephone, text message, in person, or through another staff-assisted method, the member or recipient must notify Luxe Thai Massage before the booking is finalized that the loyalty reward will be used.

The member or recipient must provide the applicable coupon code and any requested verification information.

Luxe Thai Massage is not responsible for asking whether a member has an available loyalty reward or automatically applying a reward to an appointment.

Once the stated expiration date passes, the coupon code becomes invalid, and the reward is permanently forfeited with no cash, refund, credit, replacement, extension, or exchange value.

Session Use, Appointment Cancellations, and Booking Responsibilities

Members are responsible for booking appointments in advance.

VIP Membership provides access to membership benefits and pricing but does not guarantee:

Appointment availability;
Preferred dates or times;
Specific therapists;
Therapist gender;
Specific treatment rooms;
Couples-room availability;
Appointment duration; or
Any particular service format.

Requests to cancel or reschedule an appointment must be received by Luxe Thai Massage within the applicable notice period stated below.

Requests to reschedule are subject to availability and are not guaranteed.

If Luxe Thai Massage cannot accommodate a requested reschedule, the original appointment and applicable cancellation policy remain in effect.

Appointments Canceled at Least 24 Hours in Advance

Appointments canceled at least 24 hours before the scheduled appointment time may be canceled or rescheduled without a cancellation penalty.

For an appointment paid directly with money, the amount paid will be refunded minus any applicable payment-processing fees.

A monthly included membership session used for the appointment will be returned to the member’s account only if the session remains valid and unexpired. The returned session remains subject to its original expiration date.

A loyalty reward, birthday bonus, referral reward, courtesy credit, or other complimentary or promotional benefit will be returned only if it remains valid, unexpired, and otherwise eligible under the terms governing that benefit.

Returning a session, reward, credit, or benefit does not extend, renew, or restart its original expiration period.

For an upgraded appointment using a monthly included membership session:

The eligible monthly session will be returned to the member’s account; and
The separately paid upgrade fee will be refunded minus any applicable payment-processing fees.

Paid Appointments Canceled at Least 5 Hours but Fewer Than 24 Hours in Advance

An appointment paid directly with money that is canceled at least 5 hours but fewer than 24 hours before the scheduled appointment time will incur a charge equal to 50% of the scheduled service price.

A separately paid upgrade, enhancement, or other applicable service charge associated with the appointment will be subject to the same 50% cancellation charge.

Monthly included sessions and complimentary or promotional benefits are not eligible for a 50% or prorated return. The full forfeiture requirements below apply to those sessions and benefits.

Paid Appointments Canceled Fewer Than 5 Hours in Advance and No-Shows

An appointment paid directly with money that is canceled fewer than 5 hours before the scheduled appointment time, as well as a no-show, will be charged 100% of the scheduled service price.

The appointment will not be eligible for a refund or complimentary rescheduling.

A separately paid upgrade, enhancement, or other applicable service charge associated with the appointment will also be subject to the applicable 100% cancellation charge.

Cancellation of Monthly Included Sessions and Complimentary Benefits

Appointments booked using any of the following require at least 24 hours’ cancellation notice for the session or benefit to be returned:

A monthly included membership session;
A seventh-visit loyalty reward;
A birthday bonus;
A referral reward;
A courtesy credit; or
Another complimentary or promotional benefit.

If Luxe Thai Massage receives the cancellation request at least 24 hours before the scheduled appointment time, the session or benefit will be returned only if it remains valid, unexpired, and otherwise eligible.

Returning the session or benefit does not extend, renew, or restart its original expiration period.

If the appointment is canceled fewer than 24 hours before the scheduled appointment time, the monthly session, reward, credit, or benefit used for the appointment will be forfeited in full.

A no-show will also result in the full and permanent forfeiture of the session, reward, credit, or benefit used for the appointment.

Monthly included sessions and complimentary or promotional benefits are issued and redeemed as whole benefits. They cannot be:

Divided;
Partially restored;
Prorated;
Converted into partial credits; or
Partially refunded.

After forfeiture, no replacement session, reward, refund, account credit, expiration extension, or complimentary rescheduling will be provided.

Cancellation of an Upgraded Membership Appointment

When a 90-minute or 120-minute appointment uses a monthly included membership session as the first 60 minutes:

Cancellation fewer than 24 hours before the appointment results in full forfeiture of the monthly session;
Cancellation at least 5 hours but fewer than 24 hours before the appointment results in a charge equal to 50% of the separately paid upgrade fee; and
Cancellation fewer than 5 hours before the appointment or a no-show results in a charge equal to 100% of the separately paid upgrade fee.

Late Arrivals and No-Shows

Late arrivals and no-shows are governed by Luxe Thai Massage’s general Terms and Conditions.

A member who fails to arrive within 15 minutes after the scheduled appointment time may be marked as a no-show at management’s discretion.

Once the appointment is marked as a no-show:

The appointment is forfeited;
The applicable monetary charge or membership-session forfeiture applies; and
Luxe Thai Massage may release the appointment time for another booking.

If a late-arriving member is accepted for service, the appointment may be shortened to prevent delaying the next scheduled appointment.

The appointment will end at its originally scheduled time.

The member remains responsible for the full scheduled service charge or applicable membership-session redemption. Missed service time will not be extended, restored, refunded, or credited.

Default Application of Monthly Membership Sessions

When an active member has an eligible and unexpired monthly included membership session available, Luxe Thai Massage will apply the oldest available monthly session to the member’s eligible appointment unless the member expressly requests, before the booking is finalized, to pay separately and preserve the monthly session for later use.

For a 90-minute or 120-minute appointment, an available monthly session will be applied to the first 60 minutes, and the applicable upgrade fee will be charged for the additional time.

This default applies to bookings manually processed by Luxe Thai Massage by:

Telephone;
Text message;
In person; or
Another staff-assisted booking method.

For online appointments, members are responsible for selecting the applicable membership plan or session benefit during booking and checkout.

If a member completes online payment without selecting an available monthly membership session:

The paid appointment will be honored as booked;
The unused monthly session will remain available subject to its original expiration date; and
Luxe Thai Massage is not required to refund or reverse the payment or retroactively apply the session.

Booking Requirements and Redemption Responsibilities

Members are responsible for confirming that an eligible, issued, and unexpired monthly membership session is available before booking an appointment using that benefit.

Members are responsible for communicating their intended payment or redemption method before a staff-assisted booking is finalized.

The following will not be applied automatically:

Seventh-visit loyalty rewards;
Birthday bonuses;
Courtesy credits;
Coupons; and
Other promotional benefits.

The member or recipient must request an eligible benefit before a staff-assisted booking is finalized or enter and successfully apply the applicable coupon code when online redemption is permitted.

Referral credits must be redeemed online in accordance with Luxe Thai Massage’s Referral Program Terms.

Gift cards cannot be applied toward:

Monthly membership fees;
Member-rate services; or
Membership upgrades.

Luxe Thai Massage is not responsible for asking whether a member wishes to use a reward, coupon, gift card, promotional benefit, or other available credit.

Certain services, including Couples Massage and Four Hands Massage, may be subject to additional booking requirements, including online-only booking during weekends, holidays, peak-demand periods, or other high-volume times.

Membership status does not exempt a member from those requirements.

Rollover and Expiration Policy

An unused monthly included membership session rolls over for 90 calendar days from its original issue date while the membership remains active and in good standing.

Each session retains its own issue date and expiration date.

Using a newer session does not extend an older session’s expiration date.

Returning a session following an eligible cancellation does not restart or extend its expiration period.

Expired sessions:

Are permanently invalid;
Are non-redeemable;
Cannot be restored or replaced; and
Have no cash, refund, credit, transfer, or exchange value.

Members are solely responsible for tracking and using sessions and rewards before their expiration dates.

Luxe Thai Massage is not responsible for providing expiration reminders or notifications unless otherwise required by law.

Membership Pause Requests

A member may request one membership pause of up to two (2) consecutive monthly billing cycles during the membership relationship.

A pause is subject to the following requirements:

The request must be submitted in writing;
The request should be received at least seven calendar days before the next scheduled billing date;
A pause is subject to approval by Luxe Thai Massage;
The account must be current and in good standing;
No unused monthly included membership sessions may remain on the account;
No unused seventh-visit loyalty rewards may remain available; and
The member must identify the requested pause period.

During an approved pause:

Monthly membership billing will temporarily stop;
No new monthly sessions will be issued;
Member pricing and active-member benefits will be unavailable;
Loyalty visits will not accumulate; and
The pause will not count toward the three-cycle Maturation Period.

The membership will resume automatically after the approved pause period unless the member separately submits a membership cancellation request.

A pause is not a cancellation.

A pause does not waive or refund any payment already processed.

Luxe Thai Massage may deny a pause request that does not satisfy these requirements or cannot reasonably be processed before the next billing date.

Effect of Membership Cancellation on Unused Sessions

Membership cancellation becomes effective immediately when the cancellation request is processed by Luxe Thai Massage.

The date Luxe Thai Massage processes the cancellation is the “Effective Cancellation Date.”

Upon cancellation:

Future recurring billing will stop after the cancellation has been processed;
Active-member pricing and benefits terminate immediately;
New monthly sessions will no longer be issued;
Loyalty-visit accumulation stops immediately;
Birthday benefits and shower discounts terminate immediately; and
Appointments already scheduled are not automatically canceled.

Any unused and unexpired monthly included membership sessions remaining on the account on the Effective Cancellation Date may be redeemed for 60 calendar days following that date.

The 60-day post-cancellation redemption period replaces each remaining monthly session’s previous expiration date.

After the 60-day post-cancellation period, all remaining monthly included sessions expire permanently and have no cash, refund, credit, transfer, or exchange value.

The post-cancellation period applies only to eligible monthly sessions issued before cancellation. It does not:

Reactivate the membership;
Restore member pricing generally;
Issue new sessions;
Restart loyalty accumulation;
Create a new birthday benefit; or
Extend another promotional benefit.

An eligible monthly session redeemed during the 60-day post-cancellation period may be upgraded by paying the membership upgrade rate that was in effect on the Effective Cancellation Date, subject to appointment availability.

A seventh-visit Loyalty Reward issued before membership cancellation will remain valid until the expiration date stated in the reward email.

For a Loyalty Reward issued on or after the Loyalty Reward Change Effective Date, because active-member pricing and active-member benefits terminate upon membership cancellation, a former member does not qualify for Member Redemption after the Effective Cancellation Date.

An unused and unexpired Loyalty Reward remaining after membership cancellation may instead be redeemed by the former member or gifted to another person as a $90 promotional discount in accordance with the Gifted Redemption provisions of this Policy.

Membership cancellation does not extend, renew, or restart the Loyalty Reward's original expiration period. For avoidance of doubt, the $90 post-cancellation treatment described above applies only to Loyalty Rewards issued on or after the Loyalty Reward Change Effective Date. A Loyalty Reward issued before that date remains governed by the redemption and gifting terms applicable when the reward was issued.

Membership Cancellation Requests

A member may cancel the membership by submitting a written cancellation request to Luxe Thai Massage.

Written requests may be sent by either of the following methods:

The request must include:

The member’s full name;
The email address associated with the membership account; and
A clear statement requesting cancellation of the membership.

A mailed request is considered received when it is actually delivered to Luxe Thai Massage at the address above.

An emailed request is considered received when it is delivered to Luxe Thai Massage’s email system at the email address above.

Members sending a request by mail are responsible for allowing adequate delivery time.

Members should provide at least seven (7) calendar days’ written notice before the next scheduled billing date to ensure sufficient time for the request to be received and processed before the next recurring payment.

Luxe Thai Massage will make reasonable efforts to process cancellation requests promptly.

A request received fewer than seven calendar days before the next scheduled billing date may not be processed before the upcoming payment is submitted or completed.

Luxe Thai Massage will not unreasonably delay processing a complete cancellation request. Complete email cancellation requests will ordinarily be processed within two (2) business days after receipt. If a complete cancellation request is received before the next recurring payment has been submitted for processing, Luxe Thai Massage will not intentionally submit that payment merely because fewer than seven calendar days’ notice was provided.

If the next payment is processed before cancellation is completed:

The payment will remain non-refundable except where otherwise required by law or when caused by a verified Luxe Thai Massage billing error;
The corresponding monthly included session will be issued to the account; and
The issued session will become subject to the 60-day post-cancellation redemption period once cancellation is processed.

If Luxe Thai Massage processes the cancellation before the upcoming payment is submitted, the future payment will not be intentionally processed.

Cancellation becomes effective immediately on the date Luxe Thai Massage processes the request.

Luxe Thai Massage may provide written confirmation of the cancellation and Effective Cancellation Date by email.

Membership cancellation does not automatically cancel appointments already scheduled.

The member remains responsible for separately canceling scheduled appointments in accordance with this Policy and Luxe Thai Massage’s general Terms and Conditions.

Payment Status and Good Standing

A member must remain current on all membership payments to use monthly sessions, member pricing, and other active-member benefits.

A monthly session is issued only after the corresponding payment has been successfully processed.

If a payment fails, is reversed, is disputed, or remains unpaid:

The membership may be placed out of good standing;
New monthly sessions may not be issued;
Membership benefits may be temporarily unavailable; and
Luxe Thai Massage may require the payment issue to be resolved before benefits are restored.

Resolving a failed or reversed payment does not automatically extend the expiration date of a previously issued session unless Luxe Thai Massage determines that an extension is appropriate.

Cancellation of the membership does not eliminate any valid unpaid balance or charge that arose before the Effective Cancellation Date.

Payment-Retry Grace Period

Any payment-retry, courtesy, or administrative grace period following a failed membership payment does not constitute good standing and does not restore or extend membership benefits. During this period, monthly sessions, member pricing, upgrades, loyalty benefits, and other active-member benefits may not be redeemed until the outstanding membership payment has been successfully processed.

If the payment is successfully resolved before the membership is canceled, eligible membership benefits will be restored in accordance with this Policy.

Monthly Included Session Verification and Upgrade Booking

Before booking a 90-minute or 120-minute appointment using a monthly included membership session, the member is responsible for verifying that an eligible monthly session is available and unexpired.

When an eligible monthly session is available:

It will be applied to the first 60 minutes; and
The applicable membership upgrade fee will be charged for the additional time.

If a member books an upgraded membership appointment without an eligible monthly session available, the member will be charged:

The applicable member price for the 60-minute base service;
The applicable upgrade fee; and
A disclosed $15 administrative fee when manual account review or correction is reasonably required because the member selected an unavailable or ineligible membership benefit.

The $15 administrative fee applies only when manual account review or correction is reasonably required. It is not automatically imposed merely because a member raises a billing concern or exercises a lawful payment-dispute right.

Discounts, Promotions, and Fair Use

VIP Member pricing cannot be combined with other discounts, promotions, or promo codes unless expressly permitted by this Policy or Luxe Thai Massage. The seventh-visit Loyalty Reward is an expressly permitted exception when redeemed in accordance with the Loyalty Reward Use section of this Policy.

Referral credits earned through the Luxe Thai Massage Referral Program may be used by active VIP Members only in accordance with the Referral Program Terms.

Referral credits must be redeemed online and may not be retroactively applied to a completed payment.

Except for the seventh-visit Loyalty Reward and any other benefit expressly permitted by this Policy, no other promotion, outside coupon, or unauthorized discount may be combined with VIP Member pricing.

Members may not:

Stack unauthorized offers;
Duplicate coupon codes;
Falsify eligibility;
Sell or transfer restricted benefits;
Create duplicate accounts to obtain benefits; or
Circumvent booking, payment, or reward restrictions.

Misuse may result in:

Cancellation of the affected booking;
Forfeiture of the affected promotional benefit;
Suspension of membership benefits;
Membership termination; or
Denial of future service.

Membership Abuse, Investigation, and Suspension

Luxe Thai Massage may temporarily suspend or restrict membership benefits while investigating suspected:

Benefit misuse;
Coupon or loyalty manipulation;
Payment disputes;
Fraud;
Account duplication;
Policy violations; or
Conduct or safety concerns.

A temporary suspension does not itself cancel the membership or stop recurring billing. A member who wishes to stop future billing must separately cancel the membership under the Membership Cancellation Requests section.

If monthly billing continues during an investigation, monthly sessions associated with successfully processed payments will continue to be issued to the member’s account.

If Luxe Thai Massage prevents the member from redeeming an issued monthly session during a temporary suspension and later reinstates the membership, the expiration date of each affected session will be extended by the number of calendar days during which Luxe Thai Massage prevented redemption.

If misuse or a material violation is confirmed, Luxe Thai Massage may terminate the membership, revoke promotional benefits, deny future participation, or take another action permitted by this Policy and applicable law.

If Luxe Thai Massage terminates the membership, future recurring billing will stop immediately. Any unused and unexpired paid monthly membership sessions will remain subject to the 60-day post-cancellation redemption period stated in this Policy.

If Luxe Thai Massage determines that the member cannot safely or lawfully return to the premises because of misconduct, threats, harassment, sexual misconduct, fraud, or another material safety concern, Luxe Thai Massage may prohibit in-person redemption. In that circumstance, Luxe Thai Massage will provide any refund, account adjustment, or other remedy required by applicable law, less any valid unpaid balance or other amount lawfully owed. Complimentary, promotional, and loyalty benefits may be revoked upon termination for confirmed misuse or misconduct.

Guests, Sharing, and Gift Cards

VIP benefits are intended for the enrolled member only.

Monthly included membership sessions may not be shared, gifted, sold, or transferred.

The only membership benefit that may be gifted is an eligible seventh-visit loyalty reward, as expressly permitted by this Policy.

Gift cards are non-refundable and cannot be exchanged for cash except where required by law.

Gift cards do not expire earlier than five (5) years from the date of purchase or issuance, in accordance with applicable law.

After any applicable expiration period, unused value may be void to the extent permitted by law.

Gift cards:

Must be presented at the time of service;
Cannot be applied toward membership fees;
Cannot be applied toward member-rate services;
Cannot be applied toward membership upgrades;
Are redeemable for eligible services and products at current pricing; and
Do not guarantee a specific price, promotion, therapist, date, or appointment time.

Gift cards are treated as cash and will not be replaced if lost, stolen, transferred, or used without authorization.

Luxe Thai Massage is not responsible for unauthorized gift-card use.

Adverse Weather, Emergencies, and Force Majeure

Luxe Thai Massage may cancel, reschedule, delay, or modify appointments because of:

Severe weather;
Natural disasters;
Power, water, or utility outages;
Government advisories;
Unsafe travel conditions;
Building emergencies;
Staffing emergencies; or
Other events beyond Luxe Thai Massage’s reasonable control.

If Luxe Thai Massage cancels an appointment because of such conditions, the affected monthly session, reward, or payment will not be forfeited and the appointment may be rescheduled without penalty, subject to availability.

If a member cannot attend because of severe or unsafe weather, Luxe Thai Massage may, at its sole discretion, waive an otherwise applicable charge or forfeiture.

Members should provide notice as soon as reasonably possible.

Luxe Thai Massage’s decision concerning operational and safety conditions will be final, subject to applicable law.

Exceptions and Courtesy Credits

Luxe Thai Massage may, at its sole discretion:

Waive a cancellation charge;
Return a forfeited session;
Extend a benefit;
Issue a courtesy credit; or
Permit limited-use rescheduling.

Any exception:

Is a one-time courtesy;
Does not modify this Policy;
Does not establish a continuing business practice;
Does not create precedent; and
Does not entitle the member to the same exception in the future.

A courtesy rescheduling credit may be subject to:

A specific expiration date;
Booking restrictions;
Blackout dates;
Service limitations;
Therapist limitations; and
Appointment availability.

Appointment Cancellation and Membership Cancellation Are Separate

Canceling or rescheduling an appointment does not cancel the membership or stop recurring billing.

Canceling the membership does not automatically cancel an appointment already scheduled.

Members are responsible for separately canceling:

Scheduled appointments; and
The recurring membership.

Each cancellation must comply with the applicable notice and procedure requirements.

Member Conduct and Right to Refuse Service

Members must comply with Luxe Thai Massage’s general Terms and Conditions, professional-conduct standards, draping requirements, health and safety rules, and premises policies.

Luxe Thai Massage may deny, interrupt, or terminate service and may suspend or terminate membership participation because of:

Inappropriate conduct;
Harassment;
Threatening or abusive behavior;
Sexual misconduct;
Intoxication or impairment;
Fraud;
Repeated policy violations;
Unsafe behavior;
Unlawful conduct; or
Conduct that compromises the safety or comfort of staff or guests.

Membership status does not limit Luxe Thai Massage’s right to refuse service for any lawful reason.

An appointment denied or terminated because of a member’s conduct may remain subject to the full scheduled charge or session forfeiture under Luxe Thai Massage’s general Terms and Conditions.

Luxe Thai Massage is not responsible for lost, stolen, or damaged personal property except to the extent liability cannot legally be excluded.

The limitations of liability and other legal protections stated in Luxe Thai Massage’s general Terms and Conditions apply to the membership and membership services to the fullest extent permitted by law.

Nothing in this Policy waives a right or remedy that cannot legally be waived.

Premises Monitoring

Members acknowledge that Luxe Thai Massage may use video surveillance in common areas for safety, security, loss prevention, and operational purposes, as disclosed in the general Terms and Conditions.

Common areas may include:

Entrances;
Reception areas;
Hallways; and
Exterior areas.

No recording occurs in treatment rooms, restrooms, or other areas where privacy is reasonably expected.

No Medical Guarantee

Membership participation does not guarantee a therapeutic, medical, or wellness outcome.

Massage services are provided for relaxation and general wellness purposes only.

Massage therapists do not diagnose medical conditions, prescribe treatment, or replace care from a qualified healthcare provider.

Members remain responsible for disclosing relevant health information and determining, in consultation with an appropriate healthcare professional when necessary, whether massage is suitable for them.

Electronic Communications and Notices

By enrolling and providing contact information, members agree to receive transactional membership communications by email or text message, including:

Billing notices;
Payment-failure notices;
Cancellation confirmations;
Policy updates;
Appointment communications;
Loyalty reward emails; and
Service-related notices.

Transactional communications are separate from optional marketing communications.

Marketing consent is not required to purchase or maintain the membership.

Members are responsible for maintaining accurate contact information and checking filtered email folders.

Changes to membership contact information must be submitted by email to info@luxethaimassage.com.

Failure to read a transactional communication does not invalidate an otherwise properly sent notice, reward, billing communication, or policy update, except where applicable law provides otherwise.

Modifications to Membership Terms

Luxe Thai Massage may prospectively modify:

This Policy;
Membership pricing;
Membership benefits;
Upgrade pricing;
Reward terms; or
Membership availability.

Luxe Thai Massage will provide reasonable advance notice of a material change.

A membership price change will apply no earlier than the first renewal occurring after the stated effective date of the change and any required notice period.

Changes will not retroactively:

Increase a charge already paid;
Shorten the expiration date of an already-issued monthly session;
Shorten the expiration date stated on an already-issued Loyalty Reward;
Change the cancellation terms applicable to an appointment booked before the change's effective date;
Reduce the stated redemption value of an already-issued Loyalty Reward;
Convert an already-issued complimentary gifted-massage benefit into a lower-value promotional discount; or
Materially restrict the gifting or redemption rights expressly provided with an already-issued Loyalty Reward.

This does not prevent Luxe Thai Massage from correcting fraud, duplicate redemption, misuse, an obvious clerical or system error, or another circumstance addressed elsewhere in this Policy or permitted by applicable law.

An exception may apply when a change is required by law or is reasonably necessary to address fraud, misuse, health, safety, or a material system error.

Continued membership after the effective date of a properly disclosed change constitutes acceptance of the revised Policy except where applicable law requires additional affirmative consent.

Compliance With Applicable Law

This Policy is intended to comply with applicable federal, Texas, and local law.

Nothing in this Policy:

Waives a non-waivable consumer right;
Limits a legal remedy that cannot be limited;
Authorizes a charge prohibited by law; or
Overrides a mandatory legal requirement.

If applicable law requires a different result from a provision of this Policy, applicable law will control.

No Waiver

A failure or delay by Luxe Thai Massage in enforcing a provision of this Policy does not waive the right to enforce that provision later.

A discretionary exception, courtesy, or accommodation does not amend this Policy or create a continuing obligation.

Severability

If any provision of this Policy is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as necessary.

The remaining provisions will continue in full force and effect.

Governing Law and Venue

This Policy is governed by the laws of the State of Texas.

Any legal proceeding arising from this Policy or the Luxe VIP Membership must be brought in a court of competent jurisdiction located in Bexar County, Texas, unless applicable law requires otherwise.

Membership Acknowledgment and Authorization

By enrolling in the Luxe VIP Membership, the member confirms that they:

Have read and agree to this Policy;
Have read and agree to Luxe Thai Massage’s general Terms and Conditions;
Authorize the recurring monthly membership charge;
Understand the monthly payment amount and billing frequency;
Understand that billing continues until the membership is canceled;
Understand the available methods for canceling the membership;
Understand that membership cancellation and appointment cancellation are separate;
Understand the rollover and expiration rules;
Understand the 24-hour cancellation requirement for preserving monthly sessions and complimentary benefits;
Accept the restrictions on discounts, transfers, rewards, refunds, and session use; and
Consent to receive necessary transactional membership communications.
